This website and the Telsmart services are operated by The Smart Group BV, trading as Telsmart, with registered office at Torhoutsesteenweg 236, 8210 Zedelgem, Belgium, company number BE 0554 665 992. Our second office is at Grootrees 12, 2460 Kasterlee, Belgium.

For everything described below under "Our website and marketing" and "Customers and users", Telsmart is the controller. Where we handle data on behalf of a business customer, we act as a processor, which is described separately.
Three different relationships, with different rules:

We do not ask for special categories of personal data, and we ask you not to enter any in free-text fields.
Our forms are handled by HubSpot, our CRM and marketing platform. When you submit a form, your answers are stored in HubSpot as a contact record and are visible to our sales and support colleagues.
If you started a free account, gave us your email at one of our calls to action, or booked a walkthrough, we may follow up by email about Telsmart. Every one of those emails carries an unsubscribe link that works immediately. Unsubscribing from marketing email never affects service messages about an account you actually use.
We use cookies and similar technologies. Some are strictly necessary: without them the site does not work, and for those the law does not require consent. All the others, meaning analytics, personalisation and advertising, are only placed after you have given consent through our cookie banner, and not before.
We load these technologies through Google Tag Manager. Depending on your choices, they may include:
In plain terms: these recognise your browser, so we can measure which page brought you here, avoid showing you an ad for something you already have, and show our ads to people who resemble our existing customers. They do not read the content of your calls and they have no access to our platform.
You can change or withdraw your choice at any time through the cookie settings link in the footer of every page. The full, current list of cookies, including how long each one lasts, is in that same panel, because it changes as our tools change.
To deliver a telephony service we need administrative data such as name, address, email address, phone and mobile number, language and, where legally required for identification, date of birth. We collect it through order forms, over the phone with our customer service, and by email with our people.
Using the platform produces further data: your online phone book and contacts, login credentials, and traffic data, meaning incoming and outgoing calls with date, time, duration, and the location or destination of a communication or internet connection. We also collect data on the performance and speed of your network and Wi-Fi connections.
Calls with our customer service may be recorded for training and quality purposes. You are told this at the start of the call.
Where your organisation has switched on call recording or AI summaries, calls are recorded and processed to produce a written summary. Your organisation decides whether this is on, who can see the result, and how long it is kept. Telsmart provides the tool. In Belgium, recording a call carries obligations toward everyone on the line, and it is your organisation's responsibility to inform the people involved.
Delivering the products and services ordered, connecting to the electronic communications networks of other operators, billing, customer administration, dispute handling, detecting fraud against Telsmart, its partners or third parties, improving the quality of our services, internal reporting, developing new solutions, market research, and meeting our legal obligations toward judicial and tax authorities.
The content of communications carried over our network is strictly confidential. Telsmart and its employees have no right to take note of it, and it is protected by the laws on telecommunications secrecy. We have instructed and trained our people accordingly. Calls with our own customer service can be listened back to for training and quality, which is a different thing and is announced.
Whenever a business customer processes and stores personal data of its own customers through services we supply, Telsmart acts as a processor and that customer is the controller. This applies to data the customer keeps in our data centres or cloud, data the customer enters into a Telsmart tool, and data entrusted to a Telsmart employee to prepare a configuration or activation.
We may use sub-processors. Telsmart remains responsible for protecting the personal data of the customer's end users.
End users of business customers always have the right to access and correct their personal data. If you do not receive an invoice from Telsmart, address your request to the organisation that does invoice you, because they hold the controller relationship.
We pass on to business customers the obligation to inform their own end users about the processing described here, about how to exercise their rights, and about our retention periods.
We do not sell personal data.
We choose European hosting where our suppliers offer it. Our HubSpot environment runs on HubSpot's European infrastructure. Some suppliers are nonetheless American companies that may process data outside the European Economic Area. Where that happens, it takes place under the European Commission's Standard Contractual Clauses and, where applicable, the EU-US Data Privacy Framework. You can ask us for a copy of the safeguards that apply.
The databases holding your personal data are secured against unlawful use, loss and theft. We review and adjust these measures several times a year to keep pace with what is available on the market.

Write to info@telsmart.eu and we will answer within one month. If your request is complex we may extend that by two months, and we will tell you why.

Our website contains links to sites we do not run. Those links are informational. We are not responsible for how those sites handle your data.
We update this policy when our processing changes. The date at the top tells you which version you are reading. If a change materially affects you, we will say so more clearly than by changing a date.
